These Terms and Conditions ("Terms") govern your access to and use of the website, services, and communications provided by Mload LLC ("Mload," "we," "our," or "us"), a Florida limited liability company headquartered at 1000 E Atlantic Blvd, Suite 210, Pompano Beach, FL 33060 (MC# 1421855, USDOT# 3877981). By using this website or engaging Mload for transportation services, you agree to these Terms.
1. Services
Mload is a for-hire motor carrier authorized by the Federal Motor Carrier Safety Administration (FMCSA) to transport property in interstate commerce within the United States. We provide expedited, LTL, FTL, and specialized freight transportation subject to our published rate confirmations, bills of lading, and applicable federal and state law.
2. Rate Quotes & Bookings
Rate quotes generated through this website or provided by our dispatch team are estimates based on the information you provide (pickup, delivery, weight, dimensions, equipment, and service level). Final pricing is confirmed in writing on a signed rate confirmation or bill of lading. Quotes are valid for 24 hours unless otherwise stated and are subject to equipment availability.
3. Bill of Lading & Carrier Liability
All shipments are governed by the bill of lading issued at pickup and by 49 U.S.C. § 14706 (the Carmack Amendment). Unless a higher declared value is agreed in writing prior to pickup and the corresponding surcharge is paid, Mload's liability for loss or damage is limited to the lesser of the actual invoice value or $2.50 per pound per article, up to a maximum of $100,000 per shipment.
4. Claims
Concealed damage must be noted on the delivery receipt at time of delivery. Written claims must be submitted to ops@mload.us within nine (9) months of delivery (or, in the case of non-delivery, nine (9) months from the reasonable expected delivery date) in accordance with 49 C.F.R. § 370. Suit for loss or damage must be filed within two (2) years and one (1) day of claim denial.
5. Shipper Responsibilities
The shipper is responsible for accurate description, count, weight, dimensions, hazardous-materials classification, proper packaging and blocking/bracing, and for providing safe access at pickup and delivery. Detention, layover, TONU, redelivery, lumper, and reconsignment charges accrue per the rate confirmation.
6. Payment Terms
Invoices are due Net 30 days from invoice date unless otherwise agreed in writing. Past-due balances accrue interest at 1.5% per month (18% APR) or the maximum permitted by law, whichever is lower. Payer is responsible for reasonable collection costs and attorneys' fees.
7. Hazardous Materials
Hazardous materials shipments require advance written approval, a fully executed shipper's certification, and compliance with 49 C.F.R. Parts 100–185. Undeclared hazmat is strictly prohibited and may result in refusal, additional charges, and reporting to regulatory authorities.
8. Website Use
This website is provided "as is" for informational and quote-request purposes. You agree not to misuse the site, including attempting to gain unauthorized access, scraping at volumes that impair service, or submitting false shipment information. All content, trademarks, and logos are the property of Mload LLC or their respective owners.
9. Disclaimers & Limitation of Liability
Except as expressly set forth in a signed contract of carriage, Mload disclaims all implied warranties. In no event will Mload be liable for consequential, incidental, special, or punitive damages, including lost profits, arising out of or related to the transportation services or use of this website.
10. Indemnification
You agree to defend, indemnify, and hold harmless Mload LLC and its officers, drivers, and agents from claims arising out of inaccurate shipment information, improper packaging, undeclared hazmat, or your breach of these Terms.
11. Governing Law & Venue
These Terms are governed by the laws of the State of Florida and applicable federal transportation law, without regard to conflict of law rules. Exclusive venue for any dispute lies in the state and federal courts located in Broward County, Florida.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date reflects the effective date of the current version. Continued use of the website or our services after changes constitutes acceptance.
